DETAILED GUIDELINES FOR PEE SYSTEM

4. The Textile Commissioner, Ministry of Textiles, Govt. of India, Mumbai, shall be the competent authority to decide on the eligibility and entitlement of applicants within the meaning of this system and his decision shall be final and binding.

5. Visas and export certificates under the PEE system will be issued by the Cotton Textiles Export Promotion Councils (TEXPROCIL).

6. Applications submitted in various Regional Offices of the Textile Commissioner, in the Powerloom Service Centres and the Export Promotion Councils will not be considered. Hence, it is in the interest of the applicants that they should submit their applications in the Receipt and Despatch Section of the Head Office of the Textile Commissioner at New C.G.O. Building, 48, New Marine Lines, Mumbai-400020 only, within the above stipulated date and time. In no circumstances, application(s) received after the above prescribed last date and time, due to postal/courier service delay or delay for any other reason and those submitted in any office other than the specified office, as well as those deficient in any respect will be considered. All such applications will automatically stand rejected.

7. The following documents must be furnished alongwith the duly completed application:-

  i. A photocopy of the powerloom permit obtained under the erstwhile Textile (Control) Order, 1986, renewed or otherwise or a photocopy of the acknowledgement received from the competent authority of the concerned State Government under the Textiles (Development & Regulation) Order, 1992 or under the Textiles (Development & Regulation) Order, 1993, duly attested as true copy by a Gazetted officer not below the rank of Deputy Collector. Such attested photocopies of permits/acknowledgements in respect of the looms of other family members included in the application must also be enclosed.

  ii. Photocopy of the RCMC (as manufacturer-exporter) issued by the PDEXCIL for cotton textiles and by the SRTEPC for man-made textiles, duly attested as true copy by a Gazetted officer not below the rank of Deputy Collector;

  iii. Choice of 7(seven) country-categories combination (in triplicate) for quota to be allotted, in order of preference. The list of the country-categories is furnished in the annexure-IV.

  iv. Affidavit (by the applicant, owning atleast two powerlooms) in the format as given in annexure-II. It may be noted that the name and powerlooms installation address of the applicant/applicant firm, as appearing in the application, powerloom permit/acknowledgement, RCMC and affidavit should be the same. Any discrepancies in this respect will result in the rejection of the application.

8. The application, alongwith the prescribed supporting documents, should be serially numbered and signed by the applicant, with his seal affixed thereon, if there exists such a seal with the applicant.

9. Only one common application should be submitted by an applicant for cotton and man-made fibre items/country-categories.

10. Applications which are received after the last date/time or are found, on scrutiny, to be deficient or incomplete in respect of any of the aforesaid requirements (please compare with the check list at para 7 above) are liable to be rejected, without calling for further clarification(s) or documents(s) from the applicants. The applicant should, therefore, pay special and personal attention in his own interest to ensure that his application is complete and correct in all respects and is free from any deficiency, discrepancy or any non/wrong declaration/affirmation.

11. In case of sale or disposal or change in the location of his family powerlooms, covered by the application for PEE quota, the applicant must inform the concerned State Government authorities and the Textile Commissioner, within 7 (seven) days of such sale, disposal or change of location, in terms of clause 7 of the Textiles (Development & Regulation) Order, 1993, failing which action as deemed fit under the law will be taken against the applicant/allottee of PEE quota, including recall/cancellation of quota allotted, if any.

12. For the issuance of RCMC as a manufacturer-exporter, the applicant may approach the Powerloom Development and Export Promotion Council (PDEXCIL) or the Synthetic and Rayon Textiles Export Promotion Council (SRTEPC), depending on the item/country-category for which he wants to apply for quota. The addresses, telephone/telex/fax numbers of these Councils and their regional/field offices are given in annexure-III.

13. All applications received up to the last date and time prescribed for the same in para-2 of this Memorandum shall be considered together. All available quota under the PEE system shall be distributed among all eligible applicants on a pro-rata basis after taking into consideration the extra weight assigned to applicants with more than 12 looms.

14. The Textile Commissioner may, at any time, cause an inspection of the powerlooms covered by any application, to verify the veracity of the averments made on that behalf and/or of the manufacture of the applied for/allotted items/country-categories of export quota. If as result of an inspection carried out at any time or otherwise, any discrepancy misdeclaration, misrepresentation or suppression of facts is notices vis-à-vis the application, declarations/affidavits & documents submitted by any PEE applicant/quota holder, his application shall be rejected or allocation cancelled/recalled, without prejudice to any other legal action that may be taken against him in terms of the export entitlement (quota) policy or any other applicable law(s) inforce.

15. This memorandum is issued on the basis of the export entitlement policy of the Ministry of Textiles for textiles in force, as contained in its notification, referred to in para 1 of this memorandum. If that policy is subsequently modified in any manner by the Ministry of Textiles, Government of India, New Delhi, the applications will be dealt with in the light of the policy so modified.
